Abstract

Objective: To determine how the participation of the aggrieved party influences the early termination process, Lima Centro tax district. Materials and Methods: Qualitative approach of basic type, having as research design the grounded theory, with a descriptive and explanatory level, as well as the interview guide was used in order to collect opinions of various experts who dominate the research topic, likewise, the documentary analysis guide, theoretical bases and research work were used. Results: The purpose of this scientific article was to generate evaluative knowledge based on the important participation of the injured party in the early termination process, since it was shown that early termination supports the accused but not the injured party, since many times the injured party is not satisfied with the outcome of the case, as well as with the non-compliance of the damage caused to him/her. Conclusion: It was evidenced that the early termination is effective, because it reduces the procedural burden, as well as, it generates procedural relief to the competent state entities (Public Prosecutor's Office and Judiciary); However, there is dissatisfaction on the part of the aggrieved party, since not having a lawyer, he/she will be represented by the representative of the Public Prosecutor's Office, as long as he/she does not participate in the negotiation, and the latter (prosecutor) will reach a negotiation with the sentenced person without the presence of the aggrieved party, consequently the aggrieved party does not usually take opinions and will never agree with what the representative of the Public Prosecutor's Office and the sentenced person arrive at.
